Alle Produkte sind gewissen Regeln unterworfen, bevor sie verkauft werden dürfen. So müssen sie gewissen Sicherheitsstandards entsprechen, und Konsument*innen dürfen nicht in die Irre geführt werden.

Tabak- und Nikotinprodukte stark geregelt

Manche Produkte sind stärker geregelt als andere: So benötigen Lebensmittel mehr Regeln als Bücher und Waffen mehr Regulierung als Gartengeräte. Der Grad der staatlichen Regulierung richtet sich nach dem potenziellen Schaden, der durch ein Produkt entstehen kann.

Dementsprechend stark geregelt sind Tabak- und Nikotinprodukte. Tabakprodukte sind die einzigen Konsumprodukte, die Hunderte von giftigen und krebserzeugenden Substanzen enthalten. Bei bestimmungsgemäßem Gebrauch führen sie bei einem großen Teil ihrer Nutzer*innen zu Krankheit und vorzeitigem Tod. Auch E-Zigaretten und andere Nikotinprodukte sind keine harmlosen Konsumprodukte. Außerdem ist Nikotin ein Suchtmittel und kann zu einer lebenslangen Abhängigkeit führen.

Daher müssen Tabak- und Nikotinprodukte anders reguliert sein als harmlose Konsumgüter. Wie viel der Staat vorschreibt, richtet sich also nach dem Gefährdungspotenzial.

Inhaltsstoffe, Kennzeichnung und Verpackung

Dies ist der Grund dafür, dass Tabak- und Nikotinprodukte nicht beliebig verpackt sein dürfen. Die Verpackung ist zum Teil geregelt. Auch Sicherheitsmerkmale und die Kennzeichnung sind vorgeschrieben, um so den Schutz der Konsument*innen zu erhöhen.

Tabakproduktregulation kümmert sich auch um die Frage, was überhaupt in dem Tabakprodukt drinnen sein darf – wie viel Nikotin, wie viel Teer, welche Zusatzstoffe. All dies unterliegt einem Regulativ, auf das sich die Mitgliedstaaten der Europäischen Union im Jahr 2014 geeinigt haben. Das entsprechende Gesetz heißt „EU-Tabakprodukte-Richtlinie“. Darin ist auch festgelegt, welche Qualität Tabakprodukte haben müssen und wie viel Nikotin E-Zigaretten maximal beinhalten dürfen.

In der Europäischen Union (EU) müssen Hersteller neue Tabak- und Nikotinprodukte melden, bevor sie sie auf den EU-Markt bringen.
