Tabakgesetz

Das „Tabak- und Nichtraucherinnen- bzw. Nichtraucherschutzgesetz“ (TNRSG) regelt Herstellung und Inverkehrbringen von Tabakerzeugnissen und „verwandten Erzeugnissen“ (z. B. E-Zigarette) sowie deren Bewerbung und den Nichtraucherschutz. Bis 2016 hieß dieses Gesetz „Tabakgesetz“.

Rauchverbot in öffentlichen Räumen

Seit 1.5.2009 gilt ein gesetzliches Rauchverbot an geschlossenen, öffentlichen Orten. Als öffentlicher Ort gilt jeder Ort, der ständig oder zu bestimmten Zeiten von einem vorher nicht beschränkten Personenkreis betreten werden kann. Es gibt öffentliche Orte, die vom Rauchverbot ausgenommen sind, allen voran Tabaktrafiken und Gastronomie. Die Ausnahmen in der Gastronomie waren zahlreich und nach dem „Spanischen Modell“ geregelt.

Seit 1.5.2018 gilt das Rauchverbot auch auf Freiflächen von Schulen und solchen Einrichtungen, in denen Kinder und Jugendliche beaufsichtigt, aufgenommen oder beherbergt werden sowie in Mehrzweckhallen, in Festzelten und in öffentlichen Verkehrsmitteln. Sofern Bis-18-Jährige anwesend sind, gilt das Rauchverbot auch in Vereinen und in Autos. Es besteht erweiterte Kennzeichnungspflicht für Nichtraucherbereiche.

Seit 1.11.2019 sind in der Gastronomie keine Ausnahmen vom Rauchverbot mehr zulässig. Damit sind alle Innenräume der österreichischen Gastronomiebetriebe rauchfrei. Das Rauchverbot in der Gastronomie hat in Österreich eine bewegte Geschichte.

Jugendschutz

Seit 1.1.2019 ist der Jugendschutz vor Tabak von vormals 16 Jahren auf 18 Jahre angehoben und entspricht damit internationalen Standards. Dementsprechend besteht in Österreich ein über das TNRSG geregeltes Abgabeverbot von Tabakwaren und Verwandten Erzeugnissen an Unter-18-Jährige. In den Jugendgesetzen der Bundesländer ist darüber hinaus geregelt, dass Tabakwaren und „verwandte Erzeugnisse“ erst ab 18 Jahren erworben, besessen und konsumiert werden dürfen.

E-Zigaretten

Seit 20.5.2016 sind E-Zigaretten im österreichischen Gesetz als „verwandte Erzeugnisse“ definiert. Sie sind bezüglich Rauchverboten den Tabakprodukten gleich gestellt. Das heißt: Wo Rauchverbot für Zigaretten gilt, gilt dies automatisch auch für E-Zigaretten. Bezüglich des Jugendschutzes erfolgte eine Gleichstellung mit Tabak per 1.1.2019. Auch die Werbung für E-Zigaretten ist eingeschränkt. Keine Gleichstellung gibt es bezüglich der Besteuerung und Produktregulierung. Auch fallen E-Zigaretten nicht in das Tabakmonopol, sondern dürfen frei verkauft werden.

Verpackungen

Eine Novelle des TNRSG 2016 setzte die von der EU beschlossene Tabakprodukte-Richtlinie um. Zentral sind dabei Bild-Text-Warnhinweise auf Verpackungen inklusive verpflichtender Nennung des Rauchfrei-Telefons, die Regelung von Zusatzstoffen in Tabakwaren, Sicherheitsmerkmale zur Bekämpfung des Schmuggels, die jedoch erst 2020 schlagend werden.

Tabakwerbung

Basierend auf der Richtlinie 2003/33/EG des Europäischen Parlaments und des Rates sieht das österreichische Recht ein Verbot der Werbung und des Sponsorings für Tabakerzeugnisse vor. Seit 1. Jänner 2007 ist damit etwa jegliche Plakatwerbung für Tabakerzeugnisse ausnahmslos untersagt. Aufgrund von Ausnahmebestimmungen sind jedoche  weiterhin manche Formen von Marketing und Werbung erlaubt.
